E-Commerce & Legal Disclaimer

By accessing this website, you understand and expressly agree to be legally bound by our Copyright and Trademark Notice, our Terms and Conditions (collectively, "Legal Documents"), and to comply with all applicable laws and regulations governing this website.

Shipping

Many items are in stock. However, if a product must be ordered, a minimum order of $150.00 applies due to manufacturer minimums. Orders are shipped FOB (Freight on Board) shipping point from various locations at the discretion of The Safety Equipment Store®. UPS, FedEx, LTL (Less than Truckload), or other carrier's shipping charges are added to your invoice and charged to the customer.

Large items such as safety cabinets, matting, and certain other products, which cannot be shipped via UPS, will be shipped FOB factory with LTL freight charges added to the customer's invoice.

Most manufacturers products ship free, with shipping prepaid and allowed, to the continental U.S. All shipments ship FOB ship point and the Buyer or Consignee assumes liability for goods damaged or lost during transport, although the Seller will assist Buyer or Consignee with claims to the carrier (LTL, FedEx, UPS, or other carrier) in case of damage or loss.

Hazardous and bulky items are excluded from free shipping. The customer is responsible for shipping charges related to warranty service, product returns, or any issues related to product returns, including shipping to and from the factory or any address designated by the Seller, regardless of customer location.

Shipping Hazardous Products

Products regulated as hazardous by the DOT require special packaging, handling, and may incur additional shipping charges.

Claims

The Safety Equipment Store®, and the Manufacturers we represent, take great care in filling, checking, and packaging your order. However, inspect all shipments for shortage or damage while the Freight Carrier (e.g., LTL, FedEx, UPS, or other carrier) is present and note any shortage or damage on the BOL (Bill of Lading) or confirmation of delivery you sign regardless if on an electronic device or paper. On rare occasions, a package may be damaged, short, or lost in transit. If a shipment is damaged, short, or lost, please note same on the delivery receipt and contact us the same day via email. If your shipment does not arrive as expected, please email us as well. We are here to assist you, no matter the circumstances.

Total Satisfaction Guarantee

Your satisfaction is guaranteed. If for any reason you are not completely satisfied with your order, simply contact our Customer Service Department. We won’t be satisfied until you are.

Pricing and Payment

We reserve the right to change prices without notice in the event of unforeseen changes in market conditions. Prices are net, and payment is due in U.S. dollars only. Prices do not include freight, handling, or applicable taxes. We accept the following payment methods: Visa, MasterCard, American Express, and Bank Wire.

Tax-exempt customers must provide applicable license or contract numbers. For Michigan tax-exempt customers, we are required to have a Michigan Sales Tax Certificate on file.

Return & Cancellation Policy

Due to concerns about the spread of viruses or contaminants, returns cannot be accepted. Orders may not be canceled or refunded due to strict manufacturer and distributor production schedules.

Limitations of Warranties

The goods sold by The Safety Equipment Store® are manufactured by third parties and may be covered by the manufacturer's warranty against defects in material or workmanship. A copy of the manufacturer's warranty will be provided upon request.

THE SAFETY EQUIPMENT STORE® MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE SAFETY EQUIPMENT STORE® DISCLAIMS ANY LIABILITY ARISING OUT OF BREACH OF CONTRACT OR WARRANTY, TORT CLAIMS (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHER THEORIES OF LAW.

Safety Standards and Regulations

Products sold by The Safety Equipment Store® are designed to meet U.S. safety standards. Since local safety regulations vary, The Safety Equipment Store® cannot guarantee that our products comply with all applicable regulations in each locality. The purchaser assumes responsibility for ensuring compliance with local safety standards in the locality where the products will be used or sold.

In order to access certain portions of this website or process an order, you may be given a unique password. You are responsible for maintaining the confidentiality of your password and account information and for all activities that occur under your account.

Typographical Errors, Errors in Product Name & Descriptive Information, Generic Images

In the event that a product is listed on our website at an incorrect price or with inaccurate information due to a typographical error, The Safety Equipment Store® reserves the right to cancel or refuse orders placed for the affected products. Please note that images are often generic in nature and may not represent the specific product. Review the product name, description, and other available information to ensure you are purchasing the correct product.

Order Acceptance Policy

Your receipt of an order confirmation does not signify acceptance of your order or our offer to sell. Your credit card will not be charged at the time the order is placed. We will review your order for accuracy before processing payment, and you will be notified of any changes to the order amount before your credit card is charged.

To the fullest extent permitted by law, The Safety Equipment Store® shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your use of our products or services. In no event shall The Safety Equipment Stores' total liability to you exceed the amount paid by you for the specific product or service giving rise to the claim.

Force Majeure

The Safety Equipment Store® shall not be liable for any failure to perform or delay in performance of its obligations under these Terms due to events beyond its reasonable control, including, but not limited to, natural disasters, acts of government, war, strikes, pandemics, or other unforeseeable events (collectively, "Force Majeure"). In the event of Force Majeure, The Safety Equipment Store® will promptly notify you and take reasonable steps to resume performance. If the Force Majeure event continues for more than 180 days, either party may terminate the agreement without liability.

Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration conducted in Midland, Michigan, in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator. By agreeing to these Terms, you waive the right to participate in a class action or collective proceeding. Arbitration shall be the exclusive method of dispute resolution, and no action may be brought in any court.
